RCCC withdrawn appeal

Kathmandu, September 9- On the advice of the Attorney General (AG), the Royal Commission for Corruption Control (RCCC) yesterday withdrew an appeal that it had placed before the Supreme Court (SC) challenging its own decision regarding the clean chits given to former prime minister Sher Bahadur Deuba and other six former ministers regarding the Prime Minister’s Relief Fund misuse case. The RCCC withdrew its appeal as AG Pawan Kumar Ojha advised the RCCC not to appeal against its own decision.
Spokesperson of the RCCC Prem Raj Karki had placed an appeal before the SC on Tuesday challenging the two-month-old decision of the three-member bench of the royal anti-graft body comprising RCCC chairman Bhakta Bahadur Koirala, and members Hari Babu Chaudhary and Raghu Chandra Bahadur Singh.The bench had issued clean chits to Deuba and former ministers Prakash Man Singh, Yuba Raj Gyawali, Dr Mohammad Mohsin, Jogmehar Shrestha Purna Bahadur Khadka and Hom Nath Dahal.
“We were studying the legal provisions regarding the appeal and whether to register it or not when Karki withdrew it,” said apex court joint-registrar Til Prasad Shrestha, who is also the chief of the case division of the SC The Himalya times reports . AG Ojha said, “I advised the RCCC not to appeal its own decision.” He declined to elaborate further. On questioning Karki regarding the course he would take after the withdrawal of the appeal, he said his future action regarding the issue would come in an appropriate time. “Wait for some days,” he said. However, RCCC chairman Koirala said the commission had given Karki the authority to take any course of action that he wished to take regarding the issue. “Karki has claimed that he is not satisfied with our decision, and it is up to him whether to go against our decision, or not,” Koirala added.
